Noise

Q: My neighbor plays loud music both day and
night. My landlord only permits us to play loud music until 10:00 p.m. She always stops before that time, however, the volume
of her music disturbs me. Can I do anything about this?
A: Yes, you can. Although your landlord permits
her tenants to play loud music until 10:00 p.m., your neighbor may not play her music so as to annoy or disturb you.
Section 683.01:
(a) No radio, music player, television audio system or musical instrument shall be played so as to annoy
or disturb the quiet, comfort, or repose of neighboring inhabitants or at a volume plainly audible to person other than those
who are in the room in which such device or instrument is played and who are voluntary listeners thereto.
Penalty: Violation is a misdemeanor for a first offense. The fine shall be $75.00, which fine shall not
be suspended, waived or otherwise reduced below that amount. In addition, the equipment or device used is declared to be contraband
and shall be seized and disposed of.
